| Family Educational Rights and Privacy Act (FERPA) | “The [FERPA] is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education.” | All K-12 school districts and post-secondary institutions are required to grant students and parents access to the student’s education records, including ESI. |
| Freedom of Information Act (FOIA) | “Since 1967, the [FOIA] has provided the public the right to request access to records from any federal agency … Federal agencies are required to disclose any information requested under the FOIA unless it falls under one of nine exemptions which protect interests such as personal privacy, national security, and law enforcement.” | As government agencies, public schools, colleges and universities must make all education records, including ESI, available to students and parents of students within 10 days of an FOIA request. Educational institutions are required to retain student files and grades for 10 and 30 years, respectively.
